CAA Workshop on Rights, Permissions, and Images for Publication

This workshop covers the basics of how to clear and manage rights and permissions for images for publication, and the practical problems of obtaining images for reproduction. The focus is on image use, with some attention to general issues of permissions, such as permission to quote or use texts.

This workshop is designed primarily for museum, library, and publishing professionals such as rights-and-reproductions department staff, curators, editors, conservators, and product developers, but is open to individuals as well, both authors and artists.

The workshop describes the permissions process, including:

  • Responsibilities and liabilities of author, editor, publisher, rights holder or agent, owner of the work cited or reproduced, image provider, photographer
  • Distinctions between copyright and contract or license
  • Understanding the fair-use doctrine
  • Proper citation and credit, including how to phrase accurate captions and credit lines
  • Typical policies and practices of museums and other lenders
  • Paperwork, costs, and schedules
  • The distinction between copyright infringement and plagiarism, and how to avoid both

Goals of the workshop:

  • Understand the process for clearing rights and permissions to reproduce images from the point of view of both the user (typically, an author seeking permission to reproduce images in a publication) and the lender (usually a museum, artist, or artistsŐ agency)
  • Learn the basic legal requirements and best practices in rights clearance
  • Learn to read permissions contracts and forms and identify important information in them
  • Learn how to streamline the process of granting and/or seeking permissions and images for publication
  • Reduce costs and effort of image clearance for both lender and user
  • Learn about recent developments in copyright law

The workshop is led by Eve Sinaiko, Director of Publications at the College Art Association, with Cristina Del Valle, Museum Counsel for Intellectual Property, and Susan Chun, General Manager for Collections Information Planning, at the Metropolitan Museum of Art.
